Richard Reynolds-Worden Capital Broker-Discloses 3 regulatory events, 11 customer disputes and a termination-Garden City, NY

According to publicly available records Richard Foerster Reynolds (CRD#2162706), a stockbroker who works for Worden Capital Management  discloses three regulatory events, 11 customer disputes and a termination from employment.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In May of 2016, the State of Illinois ordered sanctions that Reynolds would lose his registration as a salesperson in the state of Illinois for a period of two years when he could re-apply. The cost of investigation was also sanctioned in the amount of $150. Sanctions were ordered to satisfy allegations that Reynolds had been barred from the NYSE for five months after violating various New York Stock Exchange rules.

In October of of 2013, the State of Michigan denied Reynolds registration alleging that he had engaged in dishonest or unethical practices in the securities and investment business within the previous 10 years and that he was the subject of an order issued by the NYSE.

In December of 2007 the NYSE Division of Enforcement sought sanctions alleging that Reynolds 1) violated the NYSE rule of engaging in an outside business without consent 2) engaged in conduct inconsistent with just and equitable principles of trade by soliciting firm customers and others to invest in private securities transactions away from the firm and making misstatements to customers 3) sending correspondence to customers without supervisory review or approval. Sanctions were censure and a five month bar from NYSE.

From May of 2008 until April 2019, nine customer disputes were filed by customers firms that employed Reynolds -Janney Montgomery Scott, American Capital Partners and Worden Capital alleging among other things churning, over-concentration, unauthorized trading, unsuitability, misrepresentations, unsuitability, statutory and common law fraud, breach of contract, breach of fiduciary duty, negligence and negligent supervision. The cases were cumulatively settled for more than  $650,000. 

In April of 2010, American Capital Partners terminated Reynolds after allegations of insubordination and violation of firm policy.

Reynolds has been employed with Worden Capital Management since December of 2015. Before that he worked with Rockwell Global Capital, American Capital Partners, and Janney Montgomery Scott.

Douglas Lee-Former Worden Capital Broker- Discloses Customer Disputes-Garden City, NY

The FINRA records of Douglas Lee a stockbroker who was last employed by  Worden Capital Management disclose a pending customer dispute and  3 prior customer disputes.

In 8/2019 a  customer of Lee’s former employer ,Worden Capital Management, was paid $19,999 to  resolve allegations that Lee charged excessive commission, churned the account and made unsuitable transactions. FINRA case #19-00369

In 5/ 2017, a customer of Worden Capital Management,  was paid $12,500 in  to resolve allegations of  fraud, negligent misrepresentation, breach of fiduciary duty and breach of covenants of good faith . FINRA case #17-01266.

In July 2013 a customer of J.D. Nicholas & Associates, Inc.  settled a claim alleging that Lee made unsuitable option investments and was paid  $25,000.

In pending  FINRA case #14-03697 a customer of  J.D. Nicholas & Associate alleges churning, negligence, unsuitability, over -concentration and failure to supervise and is seeking damages of $57,130.

Lee  was employed by Worden Capital Management   from 11/2014 until 6/2015 and with J.D. Nicholas & Associates, Inc.  from 9/2009 until 11/2014.

John M. Marinaccio- Worden Capital Broker-Discloses Terminations-Ramsey, NJ

The FINRA records of John Michael Marinaccio , who is currently  employed by  Worden Capital Management disclose 2 terminations from employment.

Marinaccio worked for Laidlaw & Company from 12/ 2010 until 6/2017 when he voluntarily resigned from  Laidlaw & Company (UK)  as a result of allegations that a Regulation S-P Internal Review initiated based upon the firm learning that it’s former AML Compliance officer misappropriated non-public customer information.   A temporary restraining order completely preventing the use of any of the subject information by the formal AML CO and/or his new employer has been obtained.”

In 12/ 2017 Marinaccio was discharged by First Standard Financial Company where he had worked since 10/ 2017 . First Standard Financial made the following allegation on Marinaccio’s FINRA record :  “Firm received information concerning an alleged  Reg-S-P violation.  The internal review was commenced upon receipt of a letter from RR’s (Marinaccio’s) former employer alleging misuse of Reg S-P information…… Based upon an analysis and advise from counsel, we determined that the allegations were accurate and the IT vendor was instructed to scrub the system and delete the files. The firm terminated the RR after the conclusion of the investigation”  

Marinaccio was employed by Joseph Gunnar & Co.  from 6/ 2017 until 10/ 2017.

In 5/2018  a customer of Worden Capital Management filed FINRA case #18-01779 alleging negligence, breach of fiduciary duty, failure to supervise, breach of regulatory requirements, churning  and breach of contract in relation to the suitability of certain investments recommended by Collichio.  The case was settled in 4/2019 for $29,999.

In 7/2019, a  customerof Worden Capital Managment filed FINRA case #19-01580 alleging negligence, unsuitability, breach of fiduciary duty, breach of contract, negligent misrepresentation and omissions.  This is a multi-customer action  involving 11 clients and 12 registered representatives. Total damages sought are $559,293.   The amount of $42,358 is attributed to Callichio.

Callichio has been employed with Worden Capital Management since 3/2009.

Wallace  was employed by Worden Capital Management  from November 2014 until July 2017.   He was previously employed by A & F Financial Securities and J.D. Nicholas & Associates, Inc.
