Robert Berg-Summit Brokerage Services Broker-Discloses Customer Dispute Alleging Aggressive Trading- Danbury, CT

According to publicly available records  Robert Eugene Berg   (CRD#1218879) ,  a  stockbroker who is currently registered with Summit Brokerage Services,  disclose 1 pending and 2 prior customer disputes.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In August 2002,  a Morgan Stanley customer filed case 02-04711 alleging fraud, conversion, breach of fiduciary duty, breach of contract and excessive concentration.   The case settled for $28,604.

In December 2018, a customer with Summit Brokerage Services, filed FINRA case 18-04448 alleging aggressive and speculative investment recommendations and is seeking damages of $75,000.   This case is still pending.

Berg has been employed with Summit Brokerage Services since May of 2014.   He was with Morgan Stanley from August 2006 until 2014. He discloses an affiliation with Berg Wealth Management in Danbury.

Bill Council-Raymond James Broker- Discloses 3 Pending Customer Complaints-San Diego, CA

March 2019 – San Diego, CA

According to publicly available records William  (“Bill”) Michael Council  (CRD#848504) ,  a  stockbroker who is currently registered with Raymond James & Associates, Inc.,  disclose  3 pending customer disputes and 5 currently outstanding judgment/liens.

FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In November 2018, a client of D.A. Davidson & Co., Council’s prior employer, filed FINRA case 18-04049 alleging that Council recommended unsuitable securities. The customer is seeking damages of $334,000.

In December of 2018, another D.A. Davidson & Co. customer alleged unsuitable securities recommendations by Council  in FINRA case 19-00010.   The customer is seeking damages of $105,000 .

In November 2018, a third D.A. Davison & Co. customer filed FINRA case 18-04051 alleging Council recommended unsuitable high risk securities and is seeking damages of $50,000.

Council has been employed with Raymond James & Associates since January 2015.   He was employed with D.A. Davidson & Co. from November 2013 until January 2015.   He was with Crowell Weedon, & Co. before that.

Mark Augusta- Hilltop Securities Broker- Discloses 15 Customer Disputes, 4 Pending Customer Disputes and a Termination from Employment – Del Mar, CA

According to publicly available records Mark Fred Augusta  (CRD#1333913) ,  a  stockbroker who is currently registered with Hilltop Securities, Inc.,  disclose  15 prior customer disputes, 4 pending customer disputes and a termination from employment.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In March 2016, Mark Augusta was the subject of   FINRA Case 16-0847, brought by a customer of Wedbush Securities, who asserted violations of state and federal securities laws and FINRA/SEC Rules;  breach of fiduciary duty; unsuitable recommendations; failure to supervise; constructive fraud, common law fraud and fraud by material misrepresentations/omissions; unjust enrichment; unauthorized trading and elder financial abuse.   A FINRA arbitration panel awarded the customer $1,866,473.

In March of 2018, a Wedbush Securities , Inc. customer filed FINRA case 18-00975 alleging breach of fiduciary duty, constructive fraud, fraud by material misrepresentations/omissions, breach of written contract and elder abuse.   The case was settled for $73,900.

In February 2019,  a Wedbush Securities customer alleged unauthorized and unsuitable investments with damages of $398,832.   The case is pending.

Augusta is currently employed with Hilltop Securities.   He was previously employed with Wedbush Securities, Inc., from  January 2011 until May 2015   when he voluntarily resigned after after a customer complaint was filed against him.    Other places of Augusta’s employment were Stone & Youngberg, Piper, Jaffray & Co. and Miller & Schroeder Financial, Inc.

John Spach-Former Kestra Investment Services Broker-Discloses $450K Settlement & Termination from Employment-Calabasas, CA

According to publicly available records John William Spach  (CRD#2731192) ,  a  previously registered stockbroker who was last employed by Kestra Investment Services, LLC disclose  a recent regulatory sanction, a $450K settlement with a customer and a termination from employment.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In 2/2019, FINRA permanently barred Spach from the securities industry to resolve allegations that he failed to cooperate with a FINRA investigation.

In 4/2018,  a customer of NFP Retirement, Inc., a previous employer of Spach,  was paid $450,000 to resolve allegations that  Spach recommended that the customer invest in a promissory note that subsequently went into default.

Spach was employed with NFP Retirement Inc., from  April 2013 until July 2014 when he was discharged. NFP made the following allegations on Spach’s FINRA record:  “violations from commingling client assets with his own personal assets, breach of fiduciary duty (to include unsuitable investment advice, material misstatements, and failure to disclose material conflict of interest), circumvention of compliance policies and procedures, and operational systems and procedures of the third-party custodian, and affirmative misrepresentations to the firm. “

He was employed by Kestra from 8/2014-6/2018. He discloses a business affiliation with Spach Financial Services.

Bruce Worthington-Former Founders Financial Securities Broker-Discloses Regulatory Event, Pending Investigation, Termination & Customer Complaint-Middleton, MA

According to publicly available records Bruce C. Worthington (CRD# 2193895) ,  a  stockbroker previously employed by Founders Financial Securities, discloses a pending regulatory event, a prior regulatory event, a  pending FINRA investigation,  a termination from employment and 2 currently outstanding judgement/liens.

In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

Massachusetts regulators recently filed  complaint #E·2018·0119 against Worthington claiming that  from 2006 to 2018,  he took money from at least one retired client Massachusetts customer and he used the investment money for his own personal use and benefit.   This retired client had trusted Worthington with his account for 15 years.

In December 2018 FINRA case #2018059894201 was initiated by  FINRA.   Worthington failed to respond to FINRA request for information and he was suspended indefinitely.

In 9/2018, the United States Securities and Exchange Commission began an investigation into Worthington after concerns arose about his receipt and disposition of customer funds prior to 2013.    This investigation is still pending.

Worthington  began working  for Founders Financial Securities in June of 2013.   He  was discharged in September of 2018, and Founders Financial made the following allegations on Worthington’s record:  “The firm terminated its relationship with Mr. Worthington after concerns arose about his receipt and disposition of customer funds prior to his association with Founders Financial Securities“.

Worthington discloses a business affiliation with LifeHouse Financial Group in Rowley, MA.
