Ashley Woodard-Former VOYA Financial Broker-Subject of Customer Suit Over Illiquid Investments-Greenville, South Carolina

According to publicly available records  Ashley Charles Woodard  ,  a  stockbroker previously employed by VOYA Financial,  discloses a pending customer dispute and an outstanding judgment lien.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In 3/2019 a customer of his prior employers Voya Financial Advisors  and IFS Securities filed FINRA case 19-0624 alleging that Woodard advised him to liquidate his entire portfolio and invest in unsuitable, high risk, high fee and illiquid investments. The investments include annuities, direct investments, limited partnerships and real estate securities. This matter is currently pending. No amount of damages is specified.

Woodard also discloses a currently outstanding lien in favor of the Internal Revenue Service in the amount of $53,676, for tax years 2014,2015, and 2016. The lien is recorded in the Recorder Office of Greenville County, South Carolina.

Woodard is currently employed by NY Life Securities. His prior employment history includes: IFS Securities 2/2017-11/2017, Voya Financial Advisors 6/2013-2/2017 and Capital Investment Group 7/2011-6/2013.

Woodard discloses business affiliations with West End Financial Strategies and Eagle Strategies.

George M. Warner-Chelsea Financial Broker-Discloses Regulatory Sanction -Rockwall, TX

The FINRA records of  George M. Warner ,  a  stockbroker who is currently registered with Chelsea Financial Services disclose a prior regulatory event, a prior customer dispute and 2 terminations from employment.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In 4/2017 Warner was fined $5,000 and suspended for 30 days by FINRA to resolve allegations that he altered various customer documents on at least five occasions after the documents had already been signed by the customers. The findings stated that Warner corrected or included the customer’s anticipated liquidity needs, net worth, liquid net worth, and or annual income on new account forms, alternative investment forms, and an IRA application. FINRA Case 2014043727001. 

In 2/2010 , while employed by LPL Financial , Warner settled a customer dispute for $225,000. The customer alleged that he made an error in connection with the purchase of CIT bonds versus Citi Corp. bonds.

In 11/2014 Warner was ‘permitted to resign’ from NFP Advisors who made the following allegation on his FINRA record: “Rep corrected client documents after client signature. “

In 6/2013 Warner was discharged from LPL Financial who made the following allegation on his FINRA record: “Employment terminated by related bank program for obtaining client signatures on blank account transfer forms. “

Jim Flynn-Former Voya Financial Broker-Subject of Numerous Customer Suits Over REIT Investments-Greer, S. Carolina

Our firm recently filed several FINRA arbitrations against former VOYA Financial Advisors broker James T. Flynn. The claims by his former customers allege that Flynn made unsuitable recommendations and over concentrated the customers’ accounts in real estate investment trusts and other alternative, non liquid investments.

Flynn’s FINRA records  currently disclose  a recent regulatory suspension, 8 pending customer dispute, 14 prior customer disputes, 2 terminations from employment, a chapter 13 bankruptcy filing in 2013 and 3 outstanding judgment/liens.

In June 2018, Flynn was suspended indefinitely by FINRA for failing to respond to FINRA’s request for information in connection with a FINRA investigation.

Settlements with Flynn customers include:

In June 2018 a Voya Financial customer was paid $75,000 to resolve allegations that Flynn recommended unsuitable  alternative investments for the clients IRA and joint account.

In February 2018 a customer of Voya Financial Advisors was paid $32,912 to resolve allegations that a real estate investment trust (REIT) purchased in June 2015 was not suitable and that the customer was not aware of the risks involved or that the REIT wasn’t actively traded.

In September 2017 a customer of Voya Financial Advisors sought damages of $115,000, alleging that he questioned the suitability of real estate investment trusts (REITs) purchased in 2014 and 2015 and the replacement of a variable annuity policy. Voya paid the customer $167,673 to resolve the case in 9/2017.

In another recently resolved matter,  a customer of Voya Financial and Brookstone Securities alleged damages in connection with a $575,000 investment in annuities and real estate investment trusts (REITs). The customer alleged that they should not have been allowed to invest all of their retirement funds in unsuitable investments. In 8/2017, Voya paid the customer $196,788 to resolve the matter.

In February 2017  Flynn was discharged from Voya Financial Advisors who made the following allegation in connection therewith: “The representative provided misleading information to the Firm during a complaint investigation” related to a variable annuity.

Most recently, in 2/2018, Flynn was discharged from IFS Securities. The firm made the following allegation in connection with Flynn’s discharge: “Client alleges trading ahead of authorization.”.

Flynn discloses outstanding Federal Tax Liens of $256,165 and $18,837 and a Chapter 11 bankruptcy filing in 2013.

Jim Flynn, who is not currently registered, was employed by  IFS Securities from 2/2017-2/2018. . He was registered with Voya Financial Advisors 5/2013-2/2017, Capital Investment Group in Greer, SC, 7/2011-6/2013 and Brookstone Securities 9/2006-7/2011. Flynn discloses a business affiliation with Flynn Insurance Group and Flynn Wealth Management in Greenville, South Carolina.

The regulatory findings state that Warner corrected or included the customer’s anticipated liquidity needs, net worth, liquid net worth, and or annual income on new account forms, alternative investment forms, and an IRA application. The findings state that by changing new account documentation of the customer’s, Warner caused his member firm to preserve and maintain altered books and records. FINRA Case 2014043727001. 

In 2/2010 , while employed by LPL Financial , a customer alleged that Warner made an error in connection with the purchase of Citi Corp bonds causing losses of $329,426. That matter was settled for $225,000.

James L. Powers-Former Du Pasquier Broker-Named In Regulatory Complaint-Hoboken, NJ

According to publicly available records James L. Powers  , (CRD# 1793348) ,  a  currently unregistered stockbroker who was last registered with IFS Securities  discloses a pending  regulatory event.

FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In November 2016 FINRA filed a complaint alleging that while employed by Du Pasquier & Co., Powers used his control over firm trading accounts to create fictitious trades between a firm trading account and his personal account for his own personal profit, converted customer funds, and hid a loss he incurred in a firm trading account by repeatedly entering unauthorized, fictitious customer trades and cancelling them before settlement. FINRA Case 2014041985401. 

Powers’ prior employment includes IFS Securities, Celadon Financial Group, Aegis Capital Corp. and Du Pasquier & Co. Powers discloses that he he drives for Uber approximately 20 hours per week.
