VSR Financial Services-How to Recover Damages On Investment Losses

OCTOBER  2017VSR Financial Services closed down its operations in the Fall of 2016. Many of its brokers and clients have been transferred to Summit Brokerage Services, a related entity which is part of the Cetera Financial Group.

VSR’s  Alternative Investment Problem

Dennis Rasmusson- Former VSR Financial Broker- Discloses Customer Disputes-Scottsdale, AZ

The FINRA records of  Dennis D. Rasmusson,  a  stockbroker who is currently employed by  Berthel, Fisher & Company Financial Services, Inc.  and was previously employed by VSR Financial Services, disclose a prior regulatory event and two prior customer disputes.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In FINRA arbitration 15-00152 a customer of VSR Financial Services alleged damages of $500,000 for failure to follow instructions, trading excessively, breach of fiduciary duties, unsuitable investments, negligence, misrepresentation,  breach of contract and violations of the Nebraska Securities Act from 10/2011 to 12/2013 in connection with equity listed common and preferred stocks.   That case was settled for $110,000.

In FINRA arbitration 13-02971 a customer of VSR Financial Services alleged damages of $81,000 for portfolio mismanagement from 3/2011- 2013.   That case was settled for $34,000.

In 2011 he was fined $12,500 by the Nebraska Department of Banking and Finance to resolve allegations that he failed to record and maintain books and records and failed to maintain required net capital and policies and procedures manual.

Rasmusson has been employed by Berthel, Fisher & Company Financial Services since 3/2014. Prior to that he was employed by VSR Financial Services from 2/2011 until 3/2014. He discloses a business affiliation with Rasmusson Financial Group, Scottsdale, AZ.

John G. Lewis III-Former VSR Financial Broker-Discloses Customer Dispute Over UDF Investment-Arlington, MA

The FINRA records of  John G. Lewis III ,  a  stockbroker who is currently  employed by  Summit Brokerage Services  disclose a pending customer dispute over investments in United Development Funding.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In 12/2016 a customer filed a claim seeking an unstated amount of damages on investments in various United Development Funding investments: UDF II, UDF III, UDF IV and UDF V.

Lewis has been employed by Summit Brokerage Services since 9/2016. Prior to that he was employed by VSR Financial Services from 5/2005-9/2016.

James Regier-VSR Financial Broker-Discloses Customer Complaints Over Alternative Investments-Topeka, KS

The FINRA records of  James V. Regier,  a  stockbroker who is currently  employed by  VSR Financial Services & Summit Brokerage Services disclose 2 pending customer disputes and a prior customer dispute that is final.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

Regier, who operates ETA Financial Services in Topeka, Kansas discloses that  a complaint filed by a VSR Financial Services customer alleged that an investment in real estate securities was not suitable for her. That case was settled for $104,191 in July 2012.

In one of the pending matters filed in July 2016, a customer of VSR Financial alleges damages of $78,642 as a result of an unsuitable investment in United Development Funding IV (UDF).

In April 2016, a customer of VSR FInancial alleged that from April 2015-March 2016, unsuitable investments were made in the account by Regier. No damages are specified.

Regier has been registered with VSR Financial Services since 8/2002 and registered with Summit Brokerage Services since 9/2002. VSR is in the process of winding down operations and transferring many of the brokers and customer accounts to Summit Brokerage Services.

Bob Wamhoff-Former VSR Financial Broker-Discloses Pending Customer Disputes

UPDATE SEPTEMBER 2017Robert Wamhoff discloses 2 currently pending customer disputes:

  • 7/2017-a customer of VSR Financial Services alleges poor performance of oil and gas investments and real estate securities and seeks damages of $235,000.
  • FINRA Case 17-0919- a customer of VSR Financial Services seeks damages of $50,000 and alleges breach of fiduciary duty, suitability, ongoing fraud, violation of Missouri Securities Act and other claims.

The FINRA records of  Robert (Bob) Wamhoff,  a  stockbroker who was formerly employed by  VSR Financial Services  disclose 7 prior customer disputes that are final.

FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

Wamhoff, who operates Wamhoff Financial Planning and Accounting Services in St. Charles, MO discloses that he has settled 4 customer disputes , including:

  • FINRA Case 13-02493 in which a customer of VSR Financial Services alleged damages of $26,000  for breach of fiduciary duty, negligence and other claims related to an investment in real estate securities. That case was settled for $6,500.
  • A claim in July 2013 by a customer of VSR Financial Services who alleged unspecified damages for unsuitable investments in real estate securities and variable annuities. That case was settled for $30,000.
  • FINRA Case 9-6098 in which a customer of VSR Financial Services alleged damages of $150,000 for fraud, negligent omission and other claims in connection with investments in variable annuities, direct investments, limited partnerships and real estate securities. That case was settled for $65,000.

Wamhoff is currently employed by Calton & Associates, Inc. He was employed by VSR Financial Services from 8/2005-7/2016. He discloses a business affiliation with Bodi Enterprises dba Wamhoff Financial Planning.

Keith Chapman-Former VSR Financial Broker-Discloses Customer Dispute-Dallas, Texas

Former VSR Financial Services broker Keith E. Chapman of Chapman Wealth Management  discloses a customer dispute related to  the sale of limited partnerships, direct investments, equipment leasing investments and real estate securities. (Alternative investments)

According to FINRA records Chapman was named in  a FINRA arbitration by a customer alleging damages of $250,000 in connection with the purchase of real estate securities, equipment leasing securities and limited partnerships. The customer alleged common law fraud, unsuitable investments, negligence and breach of contract. The matter was settled for $40,000. FINRA Case# 12-3655.  According to FINRA records

Chapman  was registered with VSR Financial Services from 3/2001-9/2016. He is currently registered with Summit Brokerage Services.

Rex Securities Law is investigating former VSR Financial Services broker Gary D. Moore  in connection with the sale of limited partnerships, promissory notes and real estate securities during the time he was employed by VSR Financial Services from 6/2004-6/2007. He is currently employed by National Planning Corporation.

According to FINRA records Moore is named in FINRA arbitration #14-2969 in which a customer alleges damages of $375,000 in connection with the sale of real estate securities, promissory notes and other direct investments. The customer alleges breach of written contract, breach of fiduciary duty,  gross negligence, misrepresentations and violations of securities laws.
