Investigation-William A. Hightower-Former UBS/Legacy Asset Broker-Houston, TX

We are currently investigating former stockbroker William A. Hightower of Houston, TX, on behalf of a former UBS Financial Services client who alleges Hightower recommended that she invest in an unsuitable and illiquid investment, Reproductive Research Technologies.

Hightower was employed by UBS Financial Services from 2007-2013 and then by Legacy Asset Securities from 2013-2015.

In October 2015 Hightower was permanently barred from the securities industry by the Financial Industry Regulatory Authority (FINRA). Without admitting or denying the findings, Hightower agreed to the bar and to entry of findings that while employed by UBS Financial he failed to respond to requests for information  in connection with a FINRA investigation that he improperly referred customers to an unapproved private securities transaction. Specifically, Hightower failed to provide a list of any customers he referred to the private securities transaction.

FINRA records report that former UBS Financial Services stockbroker William A. Hightower is named in  currently pending FINRA arbitration case #15-03387 by a former customer who is seeking damages of $150,000 from UBS Financial Services.

The former UBS Financial Services customer alleges that in 2012 Hightower recommended the purchase of a high risk, illiquid and unsuitable private placement. Claimant further alleges omissions and misrepresentations regarding the recommended investment.

Losses on Tiburon Saltwater Reclamation Fund Private Placement ?

FINRA (The Financial Industry Regulatory Authority) recently filed a fraud complaint alleging that Sandlapper Securities created and sold private placements in saltwater disposal wells in Texas while charging huge markups (as much as 270%), totalling over $8 million in undisclosed markups.

Sandlapper CEO Trevor Gordon and another Sandlapper executive Jack Bixler are also named in the complaint which alleges that investors were defrauded when undisclosed markups were channeled to Sandlapper through a middleman development company owned by the defendants. FINRA Complaint No. 2014041860801. 

According to the FINRA complaint, investors in Tiburon Saltwater Reclamation Fund were led to believe that not only was their capital protected but they could also anticipate a long term return of 15%.

Damian Bell -Prior WFG Investments, Inc. Broker-Discloses Customer Disputes-Daphne, AL

According to publicly available records Damian M. Bell  (CRD#2348521) ,  a  stockbroker who was previously employed by WFG (Williams Financial Group) Investments, Inc.  disclose 2 pending and 5 prior customer disputes.

The Financial Industry Regulatory Authority (FINRA) is the agency that licenses and regulates stockbrokers and brokerage firms. FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In addition brokers are required to disclose certain financial matters such as personal bankruptcies, judgments and liens.

In April of 2017, a customer of  WFG Investments, Inc. filed a  dispute alleging unsuitable recommendations in mutual funds.   That complaint was settled for $4,950.

In March of 2016,  a customer of  WFG Investments, Inc. filed FINRA arbitration 16-0346 alleging failure to conduct a reasonable investigation into an investment in a private placement, Servergy , misrepresentation, unsuitable recommendations and breach of fiduciary duty.   That dispute was settled for $250,000.

In August 2002 a customer of Merrill Lynch, Pierce, Fenner & Smith, Inc.  filed NASD arbitration 6-4415 alleging unsuitable recommendations and failure to disclose fees.   That case settled for $40,000.

In March of 2017, a customer of  WFG Investments, Inc.  , filed FINRA arbitration #17-00822  seeking damages of $505,000 and alleging failure to conduct reasonable due diligence, material misrepresentations and failed to disclose material facts in connection with an investment in a private placement.   This case is currently pending.

In November of 2016, another customer of WFG Investments, Inc. , filed FINRA arbitration #16-03305 seeking damages of $1,100,000 alleging failure to conduct due diligence, material misrepresentations and failure to disclose material facts.  This case is currently pending.

Damian Bell was employed by   WFG Investments from April of 2010 until May of 2017. He has been employed by International Assets Advisory since 6/2017.

Matthew S. Kocsis -Cambridge Investment Research Broker-Discloses Customer Dispute-Charlotte, NC

According to publicly available records Matthew S. Kocsis, (CRD#4787057) ,  a  stockbroker who  is registered with Cambridge Investment Research discloses 2 prior customer disputes.

Kocsis was employed with Equity Services, Inc. from 6/2004 until 10/2008 and with Valic Financial Services 10/2008-8/2011. He is currently employed by Cambridge Investment Research, Inc.

Mark David Martino-Former Axiom Capital Management Broker-Discloses Customer Dispute-New York

According to publicly available records Mark David Martino  (CRD#1010228) ,  a  stockbroker who currently is employed by Ascendant Alternative Strategies  discloses a prior regulatory event, a pending customer dispute, 3 prior customer disputes and a termination from employment.

FINRA requires brokers and brokerage firms to report customer complaints and disputes as well as regulatory sanctions. In 2003, without admitting or denying the allegations, Martino agreed to a $15,000 fine and 60 days supervisory suspension to resolve allegations that he failed to adequately supervise registered representatives related to the issuance of 4 research reports.

In pending FINRA arbitration 17-1008, a customer of Axiom Capital Management seeks damages of $305,191 and alleges that Axiom and Martino committed fraud, breach of fiduciary duty and made material misrepresentations in connection with the sale of private placement investments.

Martino was discharged from Shearson Lehman Hutton in 1988.
